The existing conceptual approaches to an interpretationof a concept of functions of executive bodies and determination of the state service asforms of implementation of functions of administrative and legal bodies are researched.The analysis of the theory and practice of application of the administrative legislation inthe sphere of the organization of provision of the state services in the Russian Federation,feature of the administrative and legal nature of this legal category, its characteristicfeatures and distinctive signs, the available problems of application of the legislation inthe specified sphere and a way of their decision is provided.
The concept and content ofthe administrative legal relationship arising by provision of the state services, subjectstructure of these legal relationship is researched. Administrative and legal aspects ofincrease in efficiency of activities for provision of the state services are analysed, theemphasis on enhancement of the mechanism of administrative legal protection of therights and legitimate interests of applicants in the sphere of provision of the state services,including in individualization of the administrative responsibility of officials of executivebodies by provision of the state services Is placed.22.
