Studying all the basic concepts used in this sphere, with the help of acomparative analysis revealed the specifics and difficulties associated with the protection of objectsof ICH in comparison with the international legal protection of objects of tangible cultural heritage.The work systematically analyzed the provisions of international treaties of general character thatmay be involved in protecting the ICH, and subjected to a comprehensive analysis of the keyprovisions of the main international act in the field under consideration - the UNESCO Conventionfor the Safeguarding of Intangible Cultural Heritage 2003, and the institutional mechanism based onthese provisions and operational guidance on fulfilling obligation under this Convention.
Specialattention was paid to identifying the degree of influence of the current international legal regime forthe protection of ICH on the policies and legislation of states in this area.The work studied WIPO’s intellectual property rights protection system and WTOmultilateral agreements in the context of additional safeguards of ICH.33.
