Festo provides this electronicdocumentation in order to assistthe user in creating his machineand system documentation. In thecase of data storage deviceswhich do not accompany aproduct, i.e. which are not supplied together with that product,Festo does not guarantee that theelectronic documentation supplied separately matches theproduct actually used by the user.The latter applies particularly toextracts of the documents for theuser’s own documentation.
Theguarantee and liability for separately supplied data storage devices is limited exclusively toproper duplication of the software, whereby Festo guaranteesthat in each case the data storagedevice or software contains thelatest status of the documentation.2. Furthermore, Festo cannot beheld liable for the lack of economic success or for damage orclaims by third parties resultingfrom the use of the documentation by the user, with the exception of claims arising from infringement of the protectionrights of third parties concerningthe use of the electronic documentation.3.
The limitations of liability asper paragraphs 1 and 2 do notapply if, in cases of intent or wanton negligence or the lack of warranted quality, liability is absolutely necessary. In such a case,Festo’s liability is limited to thedamage recognizable by Festowhen the concrete circumstancesare made known.VI.
Safety guidelines/documentationGuarantee and liability claims inconformity with the regulationsmentioned above (items III. andIV) can only be made if the userhas observed the safety guidelines of the documentation in conjunction with the use of the machine and its safety guidelines.The user himself is responsible forensuring that the electronic documentation, which is not suppliedwith the product, matches theproduct actually used by the user..
