Abstract
This article examines the transformation of marriage law in the Russian Empire from 1880 to 1917 in the context of the transition from ecclesiastical to secular regulation of marriage and family relations. The study analyzes the peculiarities of marriage law at the end of the 19th century, characterized by regulatory dualism: property relations between spouses were regulated by secular legislation, while personal non-property relations and matters of marriage formation and dissolution were under church jurisdiction. The paper investigates attempts to reform marriage legislation undertaken in the early 20th century, including the draft of the new Civil Code and the Ministry of Justice bills of 1907-1909. The discussion about the possibility of introducing civil marriage, which unfolded in scientific, ecclesiastical, and public circles, is examined in detail. The main directions of the evolution of marriage law are identified: expansion of the secular component in the regulation of marriage and family relations, relaxation of restrictions on marriage, modernization of the institution of divorce, strengthening the protection of the rights of women and children, and secularization of public consciousness regarding marriage and family. The author concludes that despite gradual changes, a radical transformation of marriage legislation occurred only after the October Revolution of 1917, when an exclusively civil form of marriage was established. The evolution of marriage law in the Russian Empire during this period represented a complex and contradictory process of transition from predominantly ecclesiastical to secular regulation of family and marriage relations, which laid the foundations for subsequent changes in the Soviet era.
