Abstract

The graduate qualification paper in candidacy for the Master’s degree in law consists of three chapters, an introduction, a conclusion, and a reference list totaling 103 pages excluding supplements in 50 pages.

Key words: a document, an official document, a forgery, fraud, a crime’s element, corpus delicti, a technical and criminalistics expert examination, a preliminary investigation.

The relevance of research. The study of the classification of crimes containing a forgery as an objective aspect is an urgest issue that exists in the modern society. It is quite evident that criminals do not use violence or weapons for committing such crimes and gaining their goals. Consequences of these crimes with the element of a forgery cause material damage to the financial independence of individuals, some organizations, the society, and the state.

The object of the research is the legal relations in the field of a criminal law, criminal process and criminalistics which arise in the field of document circulation.

The subject of the research is the legal norms of the Russian legislation that regulate actions with the circulation of forged document and qualify the crimes with the element of a forgery.

The methods of the research. An analysis was applied for studying the definition of a “document” as well as the juridical definition of the corpus delictis that contain a forgery as an objective aspect of crimes. All illegal actions with a forgery were integrated by using the method of synthesis. By synthesizing all crimes can be generalized into a common criminal and legal pattern of crimes with the evidence of a forgery.

Comparative and legal method was directed to the examination of the similarities among similar concepts by discovering their specific features (falsification, counterfeit, a forgery, a false entry, etc). This method was used while studying the foreign criminal legislation, particularly that of the USA, concerning crimes with the element of a forgery. Comparative and historical method as well as the method of the analysis of laws and statutory instruments were applied to conduct the comparative analysis of the criminal law sources of the Russian Federation from ancient times until nowadays. These methods were used to compare the criminal law used in different periods of existing of the Russian Soviet Federative Socialist Republic (when it was a part of the USSR) and in the modern Russian Federation.

The sociological method was used to examine the people’s knowledge about a forgery and crimes related to it. The methods of synthesis and statistics were applied to sum up the results of the survey.

As a result of the presentation of the graduate qualification paper the legal nature of a document was studied in historical, criminalistics, and legislation aspects. The forgery of documents was examined in the historical aspect and according to the existing legislation, the criminalistics category of a “forgery” and its structure were also determined. While examining the mechanism of committing a crime the kinds and methods of forging were also considered. In the course of studying the investigation of crimes committed with the usage of forged documents the system of activities of law-enforcement authorities on the detection, investigation and suppression of crimes with the elements of a forgery was defined and offered.
