Annotation
The main normative acts on labor protection are: Fundamentals of legislation on the protection of public health, the Labour Code of the Russian Federation , the Federal Law "On the basis of labor protection in the Russian Federation ] and other legal acts adopted by the RF President, the RF Government, the Ministry of Labour and social development of the Russian Federation, federal specialized inspectorates for labor protection supervision (by the State Committee, State Technical Supervision, etc..). Currently, there are common sectoral and cross-sectoral regulations on safety and occupational health of production, many of which in order to standardize the requirements for occupational safety and health are taken into standards, and developed industry and federal safety standards system. Every employee has the right to the protection of labor, which is a fundamental right enshrined in Art. 37 of the Constitution and Art. 21 and 219 of the Labour Code. The right to health and safety worker realizes in the course of employment. The content of the right to health and safety includes the right employee to: - the workplace, according to the requirements of labor protection;compulsory social insurance against industrial accidents and occupational diseases; - Refuse to work in case of danger to life and health as a result of violations of labor protection requirements; - Provision of means of individual and collective protection at the expense of the employer; - Training in safe methods of work by the employer; - Professional training by the employer in the event of liquidation of the workplace as a result of violations of labor protection requirements; - An appeal to the state authorities and local self-government, the employer, in the trade unions on labor protection; - Personal participation or participation through their representatives in dealing with issues related to ensuring safe working conditions in the workplace, and in the investigation of what happened to him an accident at work or occupational disease; - Extraordinary medical examination (examination) in accordance with medical recommendations to preserve his place of work (position) and average earnings during the passage of the said medical examination (examination); - Compensation by the law, collective agreement, contract of employment, if the employee is engaged in heavy work or work in harmful and (or) dangerous working conditions.
