Dissertation is a complete work on the problems of security measures in the system of existing measures of the prevention and counteraction of criminal behaviour. From the point of view of the modern theory of criminal law the fundamentals, terms and concepts of security measures were researched. The research based on positions of international law, national and foreign legislation. Existing sights at genesis of criminal - legal counteraction of criminality are analysed and systematized by evolution from the absolute theory of criminal punishment (as payments, penalties) to the relative theory, with the purpose of rational application not only on penalty and payment, but also – to prevention security measures and restitution of social equity (measures of restitution and compensation). Modern interpretation of the maintenance of security measures in criminal law was researched, scientific definition of the term, system and the order of application of security measures in criminal law of Ukraine is offered.
