Despite available special laws, theRussian law still has no approach to regulate the liability of information intermediariesfor violating copyright and related rights. Besides, the Russian law does not clearlystipulate limitation of liability for certain types of information intermediaries(information intermediaries granting access to information and providers engaged incaching), and the limitation conditions for other types of information intermediaries donot fully correspond to activities they perform (information intermediaries providingInternet access services may be held liable, if they are or should be aware of violationsof copyright and related rights, while they cannot monitor activities of their users and,even if they become aware of violations of copyright and related rights a certain usercommits, cannot terminate the offense but by terminating rendering services to suchuser).The second section of the third chapter entitled Liability of InformationIntermediaries for Violations of the Right to Honor, Dignity, and BusinessReputation suggests a comparative legal analysis of regulation of liability ofinformation intermediaries for their services used to disseminate information inviolation of the right to honor, dignity, and business reputation.
This analysis identifiesthree models for regulating the liability of information intermediaries: unconditionallimitation of liability of information intermediaries (typical of the US); limitation ofliability of information intermediaries if they do not interfere in the posting ofinformation and delete or restrict access to such information upon receipt of astakeholder's notification (typical of the UK, other European Union countries, and theRussian Federation); and limitation of liability if information intermediaries areengaged in active search, deletion or restriction of access to such information (themodel used by the European Court of Human Rights).The conclusion outlines major findings of the thesis research, recommendationsand prospects of further development for the topic.21List of Publications Featuring Major Scientific Findings of the Thesis1.
